K-Design Fashion (hereinafter: ‘The Provider’) believes that ensuring the privacy and protection of your personal data is very important. With this privacy statement (hereinafter ‘Privacy Statement’), the Provider wishes to inform the user in detail about the processing of his/her personal data and corresponding rights when using the website (hereinafter ‘Website’).

Personal data processed when completing the contact form on the Website: Personal identification data are processed when a visitor contacts the Provider via a contact form on the Website. This person is looking for more information regarding the Provider’s services. As regards this processing, the processing of personal data is based on the contractual relationship and prior contacts.

Processors

The Provider uses third-party processors including Mailchimp, Sendcloud, Mollie, Mollie, etc. his includes temporarily transferring data to third parties for certain tasks or investigations if we do not have the means to perform them ourselves, such as mail platform, shipment of your order, online payment, etc. If we do so, we will always ensure that your data are treated confidentially and used in a secure manner. For instance, this processor will never be allowed to use your data on its own initiative and, except where otherwise required by law, your data must be deleted as soon as that processor has completed the assignment.

Authorities

To authorities and regulators in the context of certain legal obligations, if we suspect and/or are attempting to detect certain criminal offences, in the context of the enforcement by third parties of their intellectual property rights, if we believe that you have breached the terms of use of our Website and/or app, or if we wish to enforce our Privacy Statement.

Your personal data will not be disclosed to other external parties without prior consent or communication through this channel, unless the Provider is required to do so under a statutory provision or court order.

How long will my data be kept?

Once created, an account remains active until it is deleted. Orders awaiting payment remain active for 7 days before being deleted. Cancelled orders and failed orders remain active for 3 months before being deleted. Completed orders are retained to comply with administrative legislation.

The Provider will only retain your personal data for the minimum period necessary to fulfil the purposes set out in this Privacy Statement, unless in the event of dispute resolution or if a longer retention period is required by law for tax, social and administrative purposes. Non-personal information may be kept over time without limitation for statistical purposes.

Specifically, the data collected by the contact form is kept for 1 year after storage in order to be able to provide a service.

Your data are only actively stored for 5 years after your last order of our services. K-Design Fashion will retain your personal data for the duration necessary to achieve the intended purposes. Sometimes we are legally obliged for reasons of tax, administration and employment law to keep data for longer periods of up to 10 years, for example invoices or data that might be used should a dispute arise. K-Design Fashion may also continue to retain personal data relating to individuals who have cancelled their accounts, to respond to enquiries or complaints that may be sent after the termination of its services and to comply with all applicable laws, including tax laws.

Security and storage of data

The Provider acknowledges that personal data security is part of data protection. As a result, the Provider takes appropriate technical and organisational measures to protect your personal data against unauthorised processing or unauthorised access in order to prevent misuse.

In any transfer of personal data to a processor outside the EEA, the Provider will always do this in accordance with the terms of this Privacy Statement, and will follow applicable data protection laws and regulations to ensure adequate safeguards.

Account passwords are stored encrypted in a database and cannot be seen by clients or Processors. Characters entered by the Customer are automatically replaced.

How can I exercise my rights?

You can exercise your rights by sending an email to the Provider. To prevent any unauthorised disclosure of your personal data, the request must be sent from the email address associated with your account or contact form submission.

The Provider has 1 month to respond to your request. This period starts when the Provider has received your request and has all the information necessary to comply with your request.

The Provider will provide the requested information free of charge. Where requests are unfounded or excessive, particularly due to their repetitive nature, the Provider may charge a reasonable fee or may refuse the request.

If for some reason you assume that the Provider has not handled your request correctly, you may contact the Provider, who will then work with you to find a solution.

For the sake of completeness, we would like to inform you that if the Provider does not respond to your request, refuses it or if our response does not meet your expectations, you have the right at all times to lodge a complaint with Data Protection Authority. However, we ask that you contact us first. In the event of a dispute, we undertake to promote dialogue and openness in search of an amicable solution.

However, should no amicable solution be found, the Privacy Policy is exclusively subject to Belgian law and any dispute regarding the validity, interpretation or implementation of the Privacy Policy will fall within the exclusive jurisdiction of the courts and tribunals of the judicial district of Kortrijk, to the extent permitted by the applicable rules of international private law.

Will my data be processed outside Europe?

Your personal data will be stored within Europe. K-Design Fashion always endeavours to process personal data within the EEA as far as possible, and in any case only transfers data to a non-EEA country if that country provides an adequate level of protection within the meaning of the GDPR, or within the limits permitted by the same law, for example by ensuring data protection through appropriate contractual provisions.

What rights can I exercise?

Right of access: You can ask us which personal data we process from you, what we process it for, which categories of personal data we process, with which categories of third parties we share your personal data, the origin of the data processed and – where applicable – the logic we use when automatically processing personal data.

Right of rectification: It is currently possible for any user to correct their own account details via the Website. To keep your data up to date, we kindly ask you to make any changes yourself.

Right to erasure of data: You can ask us to delete your account. This will mean you will no longer be able to use the Website. Following the request, the Provider will suspend your account for 30 days to give you the necessary cooling-off period. After that, the account will be permanently deleted.

Right to restriction of processing: in the cases provided for in Belgian and European privacy legislation. Where processing is restricted within the Website, your personal data (except for storage) will only be processed with your consent or for the establishment, exercise or defence of legal claims or to protect the rights of another natural or legal person or for reasons of public interest. After obtaining this restriction on processing, you will always be notified by the Provider before the restriction is lifted.

Right to data portability: You have the right to obtain the personal data you have provided in a conventional, structured and machine-readable form and have the right to transfer such personal data to another controller where the processing is based on the legal grounds of consent or contractual relationship.

Right to withdraw consent: If the processing of any personal data is based on the principle of consent, as a user you have the right to withdraw this consent at any time. You can do so by cancelling your account.

Right to object: You have the right to object to the processing of your personal data only if the processing is based on public interest or a legitimate interest.
